            <p>Abgesehn v. d<ex>er</ex> »<hi rendition="#u">impropriety</hi> of such a
                    proceeding as the suspension of any Act of Parliament«, <hi rendition="#u">the
                        suspension of the B<ex>ank</ex> A<ex>ct</ex> of 1844
                        has ever resulted in obtaining enormous profits for every description of
                        money dealer</hi>, <hi rendition="#u">from the proprietors of Bank of
                        England Stock</hi>, and bankers of all descriptions, down to the <hi rendition="#u">petty usurer who discounts the bills of those whose
                        necessities compel them in such times to obtain money at the rate of 20 and
                        30% p. a</hi>. In <hi rendition="#u">October 1866</hi> the B. o. E. paid a
                        <hi rendition="#u">dividend</hi> to <hi rendition="#u">its proprietors</hi>
                    at <hi rendition="#u">the rate of 13% p. a. on a capital of £14,533,000</hi>; im
                        <hi rendition="#u">previous half year April, 1866</hi> the <hi rendition="#u">dividend was at the rate of 10<hi rendition="#sup">1</hi>/<hi rendition="#sub">2</hi>%</hi>, u. in the <hi rendition="#u">corresponding half year of 1865</hi> = 10% p. a. (34)</p>
            <p>High rates of interest entail distress on <hi rendition="#u">merchant, trader and manufacturer</hi>, and more particularly on
                    those <hi rendition="#u">employers of labour who require large sums of money to
                        pay weekly wages</hi>, and whose only safety from ruin, when money is raised
                    to an exorbitant rate, too often rests on <hi rendition="#u">suddenly
                        discharging large masses of the hard working industrious mechanics</hi>
                    employed in their extensive works. Thrown on the charity of individuals or
                    driven to the workhouse for daily sustenance, <hi rendition="#u">is it
                        surprising they become discontented</hi>, and <hi rendition="#u">feel that
                        there must be something wrong in laws that subject them and their employers

               <hi rendition="#u">application alluded</hi> to was made to the B. o. E. <hi rendition="#u">on 11 May</hi> durch <hi rendition="#u">Alderman
                        Salomons</hi>, the Chairman, with the concurrence of the daily committee and
                    some of the other directors, for an <hi rendition="#u">advance</hi> of £500,000
                    on security. <hi rendition="#u">On 12 May</hi> d<ex>ie</ex> £500,000 placed by
                    B. o. E. <hi rendition="#u">to the account of this Bank</hi>, <hi rendition="#u">£3624</hi> being paid as <pb n="6"/> discount thereon, being at the rate of
                    10% p. a.; the £500,000 to be repaid on <hi rendition="#u">the 6<hi rendition="#sup">th</hi> of
                        June</hi>, it being also agreed on the part of the B. o. E. that a further
                    sum of £500,000 was to be at the disposal of the Bank on the same terms, should

            <p>On <hi rendition="#u">21 May</hi> a letter was received from <hi rendition="#u">Mr. <persName ref="https://megadigital.bbaw.de/M9702136">Elsey</persName>
               </hi>, <hi rendition="#u">of the Bank o. E.</hi>, requesting to <hi rendition="#u">be
                        relieved from surplus amount of bills in his hands</hi>. Bis »this time (<hi rendition="#u">13 June, 1866</hi>) … not … any entry made of this important
                    transaction on the Minutes – a transaction without precedent since the formation

               <hi rendition="#u">On 15 May</hi> an <hi rendition="#u">application made by the Bk. o. E. to the L<ex>ondon</ex> and
                            W<ex>estminster</ex> B<ex>ank</ex> for the latter to pay in at the close
                        of the day as many banknotes as it could spare</hi>, irrespective of the
                    usual payments – a transaction also without precedent. (l. c.)</p>
            <p>On that evening (15 May) £140,000 accordingly paid in to the B. o. E. u. »this
                    system, <hi rendition="#u">at the request of the B. o. E.</hi>, <hi rendition="#u">was continued day by day</hi>, <hi rendition="#u">in sums</hi> varying from

                    Versicherungsgesellschaften mit einander amalgamirt … Verschmelzung, die aus …

                    kaufen. Hierbei … die übernommenen Verpflichtungen meistens zu niedrig

                    u. a., deren Thätigkeit einen colossalen Umfang annahm, u. in denen 20–30
                    kleinere Gesellschaften aufgingen. Die <hi rendition="#u">guten Risiken gingen
                        meist bei der Uebertragung verloren</hi>, die <hi rendition="#u">schlechten
                        blieben</hi>, … dann nur noch … Frage der Zeit, wie bald … Ruin … Bei meiner
                    Anwesenheit in England war dies Geschäft erst im Entstehen … hatte noch das
                    gesunde Mass nicht überschritten, u. mir (Bethel) … Gelegenheit gegeben, in
                    einigen Fällen als Sachverständiger mitzuwirken, … <hi rendition="#u">daher

               <p>⦗Wie d<ex>as</ex> Publicum bedient wird, wo d<ex>ie</ex> Staatsverwaltung
                        allein da steht, kann man erfahren, wenn man sich in <hi rendition="#u">Oberschlesien</hi> erkundigt u. wahrnimmt wie jetzt u. vor Erbauung
                            d<ex>er</ex> Rechten-Oderufer-Bahn d<ex>ie</ex> Bedürfnisse d<ex>er</ex>
                        Adjacenten befriedigt wurden. Staat hat sich bei uns die besten Bahnen
                        ausgesucht … Bei der <hi rendition="#u">Oberschlesischen</hi> u. <hi rendition="#u">Bergisch-Märkischen Bahn</hi> hat man (<persName ref="https://megadigital.bbaw.de/M0007330 http://d-nb.info/gnd/1161445986">v. d<ex>er</ex> Heydt</persName>) die Zeit nach einer
                        Crise, wo sich in Folge d<ex>er</ex> Entwicklung u. Vollendung
                        Geldbedürfnisse herausstellten dazu benutzt, um diese Bahnen in

                            D<ex>er</ex> Bauunternehmer war so Eigenthümer der sämmtlichen Actien,
                        u. er konnte nun darüber nach seinem Ermessen disponiren. (l. c.) Auch
                        vereinbart, dass er d<ex>as</ex> Recht hatte – wenn nöthig, um d<ex>ie</ex>
                        Chancen d<ex>es</ex> Geldmarkts zu benutzen, einen Theil d<ex>es</ex>
                        Capitals, ehe derselbe durch Bauleistungen von ihm verdient war – <hi rendition="#u">unter pari zu veräussern</hi>, den Erlös aber in
                            d<ex>er</ex> Gesellschaftskasse belassen müsse, bis er seiner Zeit zur
                        Zahlung berechtigt sein würde, u. dass die so asservirten Gelder ohne
                        Rücksicht auf etwaige Cursverluste ihm voll anzurechnen seien. (130, 31) Die
                        deutschen Mitglieder u. d<ex>as</ex> Ministerium d<ex>er</ex> Finanzen
                        betrachteten d<ex>ie</ex>
                  <hi rendition="#u">Capitalzeichnung einer einzigen
                            Person</hi> als nicht zureichend für d<ex>ie</ex> Sicherung d<ex>es</ex>
                        Baus. Hendry liess nun durch englische Freunde (<hi rendition="#u">bei
                            grossen Banken Betheiligte</hi>) <hi rendition="#u">d<ex>as</ex> Capital
                            zeichnen</hi> u. verpflichtete sich, sie durch d<ex>ie</ex>
                  <hi rendition="#u">Bauausführung</hi> gegen alle Ansprüche aus ihrer
                        Zeichnung schadlos zu halten. Diese Herren wurden Mitglieder d<ex>es</ex>
                        Verwaltungsraths <pb n="9"/> u. diese waren es die Bethel’s Hilfe in
                        Anspruch nahmen. (131) D<ex>er</ex> Unternehmer hatte also d<ex>ie</ex>
                  <hi rendition="#u">Actien al pari</hi> zu übernehmen.</p>
               <p>⦗D<ex>em</ex> Stroussel bekannt in England »wie Bau-Unternehmer in Folge v.
                        Veränderungen in d<ex>er</ex> Trace, in d<ex>en</ex> Plänen u. andrem ganz
                        übertriebne Mehrforderungen stellen, Gesellschaft u. d<ex>ie</ex> Mitglieder
                        dadurch in Processe u. Verluste verwickelt, Streitigkeiten aus ähnlichen
                        Anlässen als Vorwand für Fallenlassen d<ex>es</ex> Contracts benutzt, gute
                        Unternehmungen in Folge solcher Vorgänge zu Grunde gerichtet<supplied cert="high">«</supplied>. (131, 132) ⦗<hi rendition="#u">Englische
                            Usance:</hi> bei neuen Bahnen nur d<ex>as</ex> Wesentliche hergestellt,
                        Erweitrungen, Verschönerungen etc der Zukunft überlassen, gehn mit
                            d<ex>er</ex> Entwicklung d<ex>es</ex> Bau’s Hand in Hand. (132)⦘</p>
               <p>In solchen Fällen nie mit Sicherheit vorher zu bestimmen, welche <hi rendition="#u">Abweichungen</hi> erforderlich. In England <hi rendition="#u">d<ex>er</ex> Techniker</hi> – obgleich v. d<ex>er</ex>

                        Contractsbedingungen übernommen. Letztere hat er nicht vollendet, sondern,
                        laut Uebereinkommen, der Gesellschaft zur Vollendung überlassen. Bray – od.
                        vielmehr sein Banquier für ihn – besitzt noch heute den grössren Theil
                        sämmtlicher Actien, u. hat bei diesen Bahnen sein ganzes Vermögen, über
                        3 Mill. Thaler, verloren. (135)</p>

                        Stroussell schloss »einfach mit d<ex>er</ex> bestehenden Verwaltung einen
                        Contract« wonach er »die Bahn u. <hi rendition="#u">Ausrüstung für einen
                            gewissen Preis gegen Bezahlung</hi> in <hi rendition="#u">Actien u.
                            Prioritäts-actien</hi> herzustellen hatte; der <hi rendition="#u">Erlös
                            der von d<ex>en</ex> Adjacenten gezeichneten
                            Actien</hi> sowohl als d<ex>ie</ex>
                  <hi rendition="#u">Staatssubsidie</hi> wurde« ihm »in Baar gezahlt«.

                  <hi rendition="#u">Märkisch-Posener</hi> Bahn wurde wesentlich d<ex>er</ex>
                        Tilsiter Plan gewählt. (l. c.) Inzwischen im Ministerium d<ex>er</ex>
                        Grundsatz aufgenommen, dass <hi rendition="#u">nicht in
                            General-Entreprise</hi> gebaut werden durfte. Als ihm daher d<ex>ie</ex>
                        Concessionäre der <hi rendition="#u">Halle-Sorauer</hi> Bahn ihm
                            d<ex>en</ex> Bau übertragen wollten, vereinbart, dass er »<hi rendition="#u">alles Erforderliche</hi> allein <hi rendition="#u">zu
                            leisten u. zu liefern</hi> berechtigt u. verpflichtet«, es wurden
                        »Einheitssätze für jede Categorie d<ex>er</ex> Arbeiten u. Lieferungen
                        vereinbart u., wo dies nicht thunlich, Grundsätze für d<ex>ie</ex>
                  <hi rendition="#u">spätere Preisbestimmung</hi> festgesetzt. Zahlung sollte
                        wie bei den früheren Bahnen in Actien, Prioritätsactien od. Obligationen
                        geleistet werden.« Stroussel »berechnete« <hi rendition="#u">seine</hi> »<hi rendition="#u">Preise selbstverständlich</hi> mit theilweiser
                        Berücksichtigung v. Coursverlusten«; so »in diesem Fall <hi rendition="#u">das Baucapital höher</hi> geworden, als dieses bei einer
                        General-Entreprise d<ex>er</ex> Fall gewesen wäre«. Aber auch die »Ansprüche
                            d<ex>er</ex> Regierung für Festungen, Flussregulirung, grössere
                        Bahnhofsanlagen u. vieles andere … an der Vermehrung d<ex>es</ex> Capitals
                        in allen Fällen Schuld. Ich hatte nichts zu thun als auszuführen, was mir
                        befohlen wurde u. laut Preiscourant bezahlt werden musste.<supplied cert="high">«</supplied> (<choice>

               <p>Wo „Stroussell“ als Bau-Unternehmer fungirte, hat er selbst »offen diejenigen
                        Summen gezeichnet, für die mich d<ex>as</ex> Ministerium zahlungsfähig
                        hielt, u. für den Rest Zeichner besorgt, über deren Verhältnisse
                            d<ex>as</ex> Ministerium in jedem Fall eingehende Erkundigungen
                        einziehen liess. Manche wurden nicht acceptirt, bei andern d<ex>ie</ex>
                        Zeichnungssumme reducirt, u. in einigen Fällen musste ich u. mein Banquier
                        der Regierung gegenüber noch ausserdem für diese Zeichner bürgen. Die
                        Zeichner … waren <hi rendition="#u">Geschäftsfreunde, Lieferanten u.
                            Bauunternehmer</hi>, die mir vertrauten, u. denen gegenüber ich
                        schriftlich verbindliche Verpflichtungen eingegangen bin sie schados zu
                        halten ⦗»sie wurden nie in Anspruch genommen, weil ich meine Contracte
                        erfüllte«⦘ Hier offne, v. d<ex>en</ex> Behörden geprüfte Zeichnerliste,
